The North Collier Fire Control and Rescue District has adopted a Resolution establishing new impact fee rates as well as new impact fee land uses consistent with the County's. The new rates take effect on October 1, 2016. All building permits submitted October 1st or later will be assessed using the new rate schedule. On June 28, 2016, the Board of County Commissioners approved a Resolution to make the Impact Fee Program for Existing Commercial Redevelopment, a.k.a. Change of Use Program, a permanent program. Details of the Program are listed below.
On June 14, 2016, the Board of County Commissioners approved Ordinances amending the Road and Jail Impact Fees. Road fees increased by 3.7% and Jail fees increased by 3%. The amendment is effective September 12, 2016. The new fee schedules are located on the Impact Fee Schedules and Forms page.
IMPACT FEE ASSESSMENT INFORMATION:
BUILDING PERMITS: Impact fees assessed on a building permit are calculated using the rates in effect when the building permit is submitted, or at issuance of a certificate of occupancy, whichever is less. The fees are paid at issuance of a Certificate of Occupancy. Fire impact fees, which are collected on behalf of the independent fire districts, are due at permit issuance. Impact fees assessed on permits submitted to the City of Naples, City of Marco, or City of Everglades are due at permit issuance.
SITE DEVELOPMENT PLANS OR PLATS: Prior to approval of a Site Development Plan or Residential Plat, 33% of the estimated road impact fees must be paid and a Certificate of Adequate Public Facilities (COA) for transportation concurrency issued. Upon concurrency approval and payment, a COA in perpetuity will be issued concurrently with approval of the Site Development Plan or Plat.
Final calculation of the impact fees is based upon the rates in effect when the building permit is submitted, or at issuance of a certificate of occupancy, whichever is less. The remaining road impact fees, and all other impact fees, are paid prior to issuance of a Certificate of Occupancy. All impact fees for a Golf Course or an RV Park must be paid prior to approval of a Site Plan.
IMPACT FEE CHANGE OF USE PROGRAM FOR EXISTING COMMERCIAL REDEVELOPMENT:
Proposed developments which meet the criteria set forth below shall not be assessed additional impact fees related to changes of use within the existing buildings,
a. Development is proposed within a lawfully existing building which has had a Certificate of Occupancy issued for at least 3 years. Impact fees for the existing building must have been paid the then applicable impact fees at time of construction; and
b. Proposed development is solely within the existing building and does not include the addition of any new square footage.
c. Demolition and reconstruction projects are not eligible for this program.
d. For the purposes of water and wastewater impact fees, projects that require an existing meter to be upsized are not eligible for this program.
